Breathesober provides breathwork-based sobriety coaching and nervous system regulation programs. Our Services are educational and coaching in nature. We are not a medical provider, licensed therapist, or addiction treatment facility. Nothing in our Services constitutes medical advice, psychological treatment, or clinical care.

If you are experiencing a medical emergency or a mental health crisis, please contact emergency services or a licensed healthcare provider immediately.

3. Program Enrollment and Payment

• Program fees, payment schedules, and inclusions are outlined at the point of purchase.
• All payments are due as specified at enrollment. We reserve the right to suspend access to Services for non-payment.
• Payments are processed through secure third-party payment processors. We do not store your full payment card details.

4. Refund Policy

Due to the nature of our digital and coaching services, all sales are final unless otherwise stated in writing at the time of purchase. If you have concerns about your program, please contact us at support@breathesober.com and we will work with you in good faith.

5. Client Responsibilities

By enrolling in our Services, you agree to:

• Engage honestly and in good faith during coaching sessions
• Take personal responsibility for your choices and outcomes
• Not share program materials, recordings, or content with third parties
• Treat coaches, staff, and fellow group members with respect
• Acknowledge that results vary and are not guaranteed

6. Intellectual Property

All content, materials, frameworks, recordings, and resources provided through Breathesober’s Services are the exclusive intellectual property of Breathesober. You may not reproduce, distribute, modify, or resell any materials without our prior written consent.

7. Confidentiality

We treat all information shared during coaching sessions as confidential. Group coaching participants are expected to maintain the confidentiality of other members’ disclosures. We will not disclose your personal information except as described in our Privacy Policy or as required by law.

8. Disclaimer of Warranties

Our Services are provided “as is” and “as available.” We make no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, or suitability of our Services for any particular purpose. We do not guarantee specific outcomes, results, or sobriety milestones.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Breathesober, its coaches, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our Services. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the three months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Breathesober and its officers, coaches, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of our Services, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your access to our Services at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to Breathesober, our coaches, or other clients. In such cases, refunds will not be issued.

12. Third-Party Services

Our Services may integrate with or link to third-party platforms (such as video conferencing tools, community platforms, or payment processors). We are not responsible for the terms, privacy practices, or performance of any third-party services.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
